Welcome to RxPass. RxPass is a supplemental membership made available to eligible Prime members.
These RxPass Terms of Use (the “RxPass Terms”) govern our respective rights and obligations, and are between you and PillPack LLC and its affiliate pharmacies (“Amazon Pharmacy”), and Amazon.com Services LLC and/or its affiliates (collectively, “Amazon.com” or “Us”). Please note that your use of the RxPass membership is governed by the agreements listed and linked to below. If you subscribe to RxPass, you accept these terms, conditions, limitations, and requirements. RXPASS IS NOT INSURANCE. IT IS A SUBSCRIPTION-BASED PRESCRIPTION SAVINGS BENEFIT.

Participating Providers
Amazon Pharmacy is the sole participating provider in the RxPass program.
Eligibility
In order to subscribe to RxPass, you must be a Prime member, and have an Amazon Pharmacy account. Only one person on an Amazon account may enroll in RxPass at a time. You can change the individual on your Prime account that is enrolled in RxPass by contacting Amazon Pharmacy customer service. RxPass is only available in the United States, and is not available in the states of California, Texas, and Washington. RxPass is not available to you if you are a beneficiary of some state sponsored health programs including Medicaid and Children’s Health Insurance Program (CHIP). We will check to ensure that you meet these enrollment criteria when you initially subscribe to RxPass, and each time you make an Eligible Purchase (as defined below). RxPass cannot be combined with any insurance benefit, copay assistance program, or other third-party financial benefits.
Fees and Renewal
You agree to pay Us a monthly fee for your RxPass subscription, which allows you to obtain discounts on prescription medications at Amazon Pharmacy. The membership fee for RxPass is stated in the Amazon Pharmacy Account Settings section, under the Subscriptions tab. From time to time, we may offer different membership terms, and the fees for such memberships may vary. The RxPass membership fee is not refundable, except as expressly set forth in these RxPass Terms. Tax may apply on either or both of the monthly fee or eligible purchases through RxPass. On the date you subscribe to RxPass, we will charge you a prorated monthly fee, followed by the full fee on the first calendar date of every subsequent month.
If all eligible payment methods we have on file for you are declined for payment of your membership fee, you must provide Us a new eligible payment method promptly or your membership will be canceled. If you provide Us with a new eligible payment method and are successfully charged, your new membership period will be based on the date of the successful charge.
UNLESS YOU NOTIFY US BEFORE A CHARGE THAT YOU WANT TO CANCEL OR DO NOT WANT TO AUTO RENEW, YOU UNDERSTAND YOUR RXPASS MEMBERSHIP WILL AUTOMATICALLY CONTINUE AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU, UNLESS REQUIRED BY APPLICABLE LAW) TO COLLECT THE THEN-APPLICABLE RXPASS MEMBERSHIP FEE AND ANY TAXES, USING ANY ELIGIBLE PAYMENT METHOD WE HAVE ON RECORD FOR YOU.
Eligible Purchases
You may only purchase prescription medication through RxPass pursuant to a valid prescription. The list of medications available through RxPass, the discounted price, and any additional fees will be stated in the RxPass Home Page. The list of medications available through RxPass may be modified from time to time.
Larger Days’ Supply
For certain medications, it may be possible for Amazon Pharmacy to dispense more than a month’s supply of medication. If your medication is available at a larger days’ supply, we will let you know and you may opt in to receive it.
Cancellation and Refunds
You may cancel your RxPass subscription at any time by visiting your Amazon Pharmacy Account Settings under the Subscription tab, and adjusting your membership settings, or by calling Amazon Pharmacy customer service. If you cancel your RxPass subscription within the first 30 days of your membership, we will refund 100% of your RxPass membership fees and your cancellation will be effective immediately following Amazon’s receipt of your cancellation notice. If you cancel your RxPass subscription any time after the first 30 days of your membership, your cancellation will be effective on the last date of the calendar month in which you cancel.
Changes
We may in our discretion change these RxPass Terms, Amazon Prime’s Terms & Conditions, Amazon.com's Conditions of Use and Privacy Notice, or any aspect of RxPass, without notice to you. If any change to these RxPass Terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED USE OF RXPASS AFTER WE CHANGE THESE RXPASS TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR RXPASS SUBSCRIPTION.
Termination By Us
We may terminate your RxPass subscription at our discretion without notice. Our failure to insist upon or enforce your strict compliance with these RxPass Terms will not constitute a waiver of any of our rights. We may refuse to permit you to reenroll in RxPass at our discretion.
LIMITATION OF LIABILITY
IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN AMAZON.COM'S CONDITIONS OF USE, AMAZON PRIME’S TERMS & CONDITIONS, OR AMAZON PHARMACY’S TERMS OF USE, OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST PRIME RX MEMBERSHIP FEE YOU PAID. THIS LIMITATION OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR RXPASS SUBSCRIPTION.
Program Administration and Complaints
RxPass is administered by Inside Rx, LLC, 1 Express Way, St. Louis, MO 63121. For more information about RxPass, or to file a complaint, call 1-855-745-5725. You can also contact your state’s Department of Insurance to file a complaint. Contact Us if you need assistance with filing such a complaint.
Disputes
Any dispute or claim relating in any way to your use of RxPass or these RxPass Terms will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of this Agreement as a court would.To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our registered agent Corporation Service Company, 300 Deschutes Way SW, Suite 304, Tumwater, WA 98501. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. We will reimburse those fees for claims totaling less than $10,000 unless the arbitrator determines the claims are frivolous. Likewise, Amazon will not seek attorneys' fees and costs in arbitration unless the arbitrator determines the claims are frivolous. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.
We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration
we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.
